salaryMD is an online platform that helps physicians understand how their compensation offers compare to the market. The Service generates reports and assessments using proprietary models and industry compensation data.
THE SERVICE PROVIDES MARKET INTELLIGENCE ONLY. Nothing provided by salaryMD constitutes:
• Legal advice or legal counsel of any kind
• Financial advice, investment advice, or tax advice
• A formal fair market value ("FMV") opinion or appraisal
• A regulatory compliance determination under the Stark Law (42 U.S.C. § 1395nn), the Anti-Kickback Statute (42 U.S.C. § 1320a-7b), or any other federal or state law or regulation
• A substitute for consultation with a qualified attorney, accountant, financial advisor, or certified valuation professional

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SALARYMD, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to damages for loss of income, lost profits, loss of business opportunity, or loss of data, arising out of or related to your use of the Service, whether based on warranty, contract, tort, negligence, strict liability, or any other legal theory, even if salaryMD has been advised of the possibility of such damages.
In no event shall salaryMD's total liability to you for all claims arising from or related to the Service exceed the amount you paid to salaryMD for the specific report or service giving rise to the claim.
Without limiting the foregoing, salaryMD bears no liability for: (a) compensation decisions made using information from the Service; (b) negotiation outcomes or employment decisions; (c) regulatory compliance determinations, audits, or enforcement actions; (d) any third party's reliance on reports generated by the Service.
You are responsible for: (a) the accuracy of information you provide to the Service; (b) determining the appropriateness of using the Service for your specific situation; (c) consulting with qualified professionals before making compensation or contractual decisions; (d) complying with all applicable laws and regulations.
You agree not to: (a) use the Service to generate reports for the purpose of resale without authorization; (b) reverse-engineer, decompile, or attempt to derive the algorithms, data sources, or methodology underlying the Service; (c) represent salaryMD reports as formal FMV opinions, legal analyses, or regulatory compliance documentation; (d) use the Service in any manner that violates applicable law.
All content, data, methodologies, algorithms, models, reports, designs, and software comprising the Service are the exclusive intellectual property of salaryMD and are protected by copyright, trade secret, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any portion of the Service without prior written consent.
Reports generated for you are licensed for your personal or internal organizational use only. You may share reports with your personal advisors (attorney, financial advisor, accountant). You may not publish, redistribute, or sublicense reports without authorization.
Individual plans (One Contract, Multiple Offers) are one-time purchases and are non-refundable once a report has been generated. If you purchase a plan and have not yet generated a report, you may request a refund within 7 days of purchase.
Organization plans are billed monthly or annually and may be canceled at any time. No refunds are provided for partial billing periods.
You agree to indemnify, defend, and hold harmless salaryMD and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any law or the rights of any third party; (d) any reliance by you or any third party on information provided by the Service.
Any dispute arising from or related to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in [Your State]. Each party shall bear its own costs and attorneys' fees. You agree that any arbitration shall be conducted on an individual basis and not as a class action or representative proceeding.

• Account information: email address, name (if provided), specialty, and professional role
• Offer details: compensation figures, ZIP code of position, practice setting, call schedule, administrative duties, teaching arrangements, and other offer-related inputs
• Payment information: processed by our third-party payment processor (Stripe). We do not store credit card numbers, CVVs, or full payment credentials on our servers
• Communications: emails, support requests, or feedback you send us
Information collected automatically:
• Usage data: pages visited, features used, time spent, report generation events
• Device information: browser type, operating system, screen resolution
• Network information: IP address, approximate geographic location (city/region level)
• Cookies and similar technologies: session cookies for authentication and preferences. See Section 5 for cookie details
We use your information for the following purposes:
• To provide the Service: Generate compensation reports, run market comparisons, and deliver data adjusted to your area based on your inputs
• To process payments: Fulfill purchases and manage subscriptions
• To improve the Service: Analyze usage patterns to improve accuracy, user experience, and feature development
• To communicate with you: Send transactional emails (purchase confirmations, report delivery), respond to support requests, and, with your consent, send product updates
• To maintain security: Detect fraud, prevent abuse, and protect the integrity of the platform
To be explicit:
• We do NOT sell your personal information to third parties. Ever.
• We do NOT share your individual compensation data, offer details, or reports with employers, recruiters, health systems, or any other party
• We do NOT display advertising or allow advertisers to target you based on your data
• We do NOT use your individual inputs to train machine learning models
• We do NOT provide individual user data to data brokers
We share information only in the following limited circumstances:
• Payment processor (Stripe): Payment details necessary to process transactions
• Infrastructure providers: Hosting and cloud services necessary to operate the platform (e.g., Netlify, AWS). These providers are bound by data processing agreements
• Legal requirements: When required by law, subpoena, court order, or government request
• Business transfers: In connection with a merger, acquisition, or sale of assets, with notice to affected users
• Aggregate/anonymized data: We may publish aggregate, de-identified statistics (e.g., "average cardiologist offer in the Northeast increased 4% year-over-year") that cannot be traced to any individual user
We use the following types of cookies:
• Essential cookies: Required for authentication, session management, and security. Cannot be disabled.

• Usage data: Retained in aggregate form indefinitely; individual-level usage data is deleted after 24 months

The Service is intended for healthcare professionals and is not directed at individuals under the age of 18. We do not knowingly collect personal information from minors.
We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on the platform and, where appropriate, by email. Your continued use of the Service after changes constitutes acceptance of the updated policy.
